New Home Warranty Claims and Construction Warranty Claims
The Homeowner Protection Act provides important protection for homeowners. Enacted in 1998 after the “leaky condo” crisis, the Act establishes a 2-5-10 warranty for new homes and licensing requirements for builders.
The 2-5-10 warranty created by the Homeowner Protection Act provides the following coverage:
- 2 years for defects in materials and labour
- 5 years for building envelope defects
- 10 years for structural defects
Partner and founder John Mendes oversees our construction defect practice. We assist strata corporations and homeowners with claims against 2-5-10 warranty providers under the Homeowner Protection Act. We also enforce claims against developers, consultants, contractors, municipalities and other parties involved in the construction of defective condominiums and homes.
Our lawyers help strata corporations and owners resolve 2-5-10 warranty and other construction claims through mediation and, where necessary, litigation.
